| dc.description.abstract | 본 연구는 추급권이 실효적으로 입법되기 위해 전제되어야 할 역사적 배경, 취지, 법적 성격 및 입법례를 조사하고, NFT시장 현황에 비추어 추급권 도입의 필요성과 블록체인 기술 활용의 타당성을 검토한 후 블록체인 기반의 추급권 운영모델을 제안하였다. 이를 위해 본 연구는 다음 세 가지 논거를 분석하여 제시하였다. 첫째, 추급권 도입 반대론의 주된 이유로 거론되는 미술시장 위축 우려는 2007년 WIPO 보고서에 이어 NFT 2차 시장의 번성으로 다시 한번 반증되었다. 둘째, 미술시장과 NFT시장의 추급권료 규모 및 요율을 비교하여 블록체인 기술의 효율성을 검증하였다. 셋째, 블록체인 기술의 특성과 활용사례를 분석하고 추급권 적용 시 고려해야 할 사항을 도출하였다. | - |
